Terms of Service

1. Who we are and what this is

These Terms of Service ("Terms") govern your use of Cherish (the "Service"), an online platform where subscribers exchange messages with AI-generated companion characters ("Personas"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The companions are AI

Every Persona on Cherish is a fictional character powered by artificial intelligence. Personas are not real people. Their photos are AI-generated images of people who do not exist, and their messages are generated by a language model. Conversations are for entertainment and companionship-style interaction only.

• Persona replies may be inaccurate, inconsistent, or fictional. Do not rely on them as factual information.
• Personas do not provide medical, mental-health, legal, financial, or other professional advice, and nothing they say should be treated as such.
• The Service is not a substitute for human relationships, therapy, or emergency services. If you are in crisis or thinking about harming yourself, contact your local emergency number or a crisis line (in the US, call or text 988).

3. Eligibility — 18+

You must be at least 18 years old (or the age of majority where you live, if higher) to use Cherish. By creating an account you confirm your date of birth truthfully and confirm that you are 18 or older. We may suspend accounts we reasonably believe belong to minors.

4. Your account

You are responsible for the accuracy of your registration details and for keeping your password and session secure. One person per account; do not share credentials or resell access. We may suspend or terminate accounts that violate these Terms.

5. Subscriptions, billing, and cancellation

• Chatting with a Persona requires a paid subscription for that Persona. Prices are shown at checkout.
• Payments are processed by Stripe; we never see or store your card number.
• Subscriptions renew automatically each month until cancelled. You can cancel any time via Profile → Manage subscription, which opens Stripe's billing portal. Cancellation stops future renewals; you keep access for the period you have already paid.
• If a renewal payment fails, we allow a short grace period (currently 3 days) and then pause access until payment succeeds.
• Except where required by law, payments are non-refundable.

6. Acceptable use

You agree not to:

• use the Service if you are under 18, or make content from it available to minors;
• attempt to access other users' accounts or data;
• probe, overload, reverse-engineer, scrape, or disrupt the Service, or circumvent rate limits, message caps, or the subscription paywall;
• use the Service to generate or solicit content that is illegal, that sexualizes minors in any way, or that promotes violence or self-harm;
• use the Service for commercial purposes, spam, or automated traffic.

We may moderate, limit, suspend, or terminate accounts that violate this section.

7. Your content and our license

You keep ownership of the messages you write. You grant us the limited license needed to operate the Service: storing your messages, sending them (with recent conversation context) to our AI infrastructure to generate replies, and maintaining a conversation-memory summary so your companion remembers you. 8. Our content

The Service — including Persona characters, images, branding, and software — is owned by us or our licensors. You may not copy, redistribute, or create derivative works from it outside normal personal use of the Service.

9. Deleting your account

You may delete your account at any time from Profile → Delete account. Deletion cancels any active subscriptions, and permanently removes your account, chat history, and conversation memory as described in the Privacy Policy.

10. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages arising from your use of the Service, and our total liability for any claim is limited to the amount you paid us in the three months before the claim arose. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Changes to the Service or these Terms

We may modify or discontinue features, Personas, or pricing. We may update these Terms; if we make material changes we will post the updated Terms here with a new "Last updated" date, and continued use of the Service after that constitutes acceptance.
